  In many cases, people who have been charged with a DUI in New Jersey see no choice other than to plead guilty. You may think you are guilty and that you should therefore plead guilty.

  • 1What are the penalties if I plead guilty? New Jersey 's DWI penalties are severe even for first DUI offense. It involves fines, fees and surcharges, license suspension, ignition interlock device, jail time and community service.
  • 2I plead guilty to DUI charge, can I reverse my decision? It's possible, however simply changing your mind is usually a weak ground. There are cases where you would have a strong ground to appeal. In New Jersey Municipal Court, you have twenty days to appeal your DUI convictions. Don't plead without legal advice. The State has to prove "Beyond a Reasonable Doubt" that you are guilty, a high standard for the State to meet.
  • 3What will happen to my insurance coverage and rates if I plead guilty? DWI conviction in New Jersey allows insurance carriers to refuse to renew your coverage. Insurance will still be available through a different plan known as NJ PAIP, however your rates will increase dramatically (can be double or triple). You must pay insurance company $1,000/year surcharge for 3 years.
  • 4Is it possible to obtain a conditional driver's license to go to and from work if I plead guilty? No you cannot. The revocation of your driver's license in New Jersey is mandatory without any exceptions. No "Special" licenses.
  • 5Can I "plea bargain" a New Jersey DWI charge? No plea agreements are allowed in New Jersey DWI cases. However there are cases where we negotiate with the Prosecutors and dismiss the charge or reduce it to one that conforms to the evidence.
